Assault & Battery
An
assault is an attempted battery. A battery is
any physical contact with another person, to
which that other person has not consented.
Assault and battery can be charged as a
misdemeanor or a
felony, depending on
the circumstance of the case.
There are serious consequences for a battery
conviction. If you are convicted of a battery,
you could obtain a criminal record, receive
imprisonment, probation.
You may be required to do anger management
classes, pay fines and loss of the right to
possess firearms In addition, if you use a
weapon, you could be charged with an assault
with a deadly weapon. Under the “Three Strikes”
law, this can be considered a strike and may
lead to a prison sentence.
