Dealing With DMV in Fresno (Department of Motor Vehicles)

dmvIf you received a driving under the influence (DUI/DWI) charge in California, you must contact DMV immediately. To receive a hearing in order to prevent an automatic suspension, you MUST contact the Department of Motor Vehicles within 10 days of your arrest.  You have the right to request a hearing from the DMV and if the review shows there is no basis for the suspension or revocation, the action will be set aside. It is extremely important to request the hearing even if you believe you are guilty.  DMV has different rules that are required to be followed. Many times, clients could have kept their license if they would have asked for the hearing.

There are three issues that the Hearing Officer will evaluate to determine if your suspension should be set aside:

1) Did the police officer have reasonable cause to believe the individual was driving a motor vehicle in violation of Vehicle Code section 23152, 23153, or 23140?
2) Was the individual placed under lawful arrest?
3) Was the individual driving a motor vehicle at .08% BAC or more?

If you refused to take a breath, blood or urine test after being arrested for DUI, or if the results of your breath test were .08% blood-alcohol or above, your license will be suspended 30 days after the arrest unless you or your attorney request an administrative hearing within 10 days after arrest.

If you are under 21, you are facing an automatic one-year suspension of your license. To protect your rights, we will seek a hardship license on your behalf. A hardship license can allow you to drive during the one-year automatic suspension period.

If a commercial driver has a BAC of .04 percent or more while in the commercial vehicle, he or she could be convicted of a DUI. If a commercial driver gets a DUI in a non-commercial vehicle, this can cause problems with the driver’s license. If you are a commercial driver, it is very important to speak to an attorney immediately because there are serious licensing problems that can occur.
